YOU ARE HERBY COMMANDED to cause to be posted (for ten days, exclusive of the day of posting,) in three of the most public places in your County, one of which shall be at the Court House door, and no two in the same city or town, copies of the following notice:

TO ALL PERSONS INTERESTED IN THE Estate of Nelson Conner, Dec’d

Know ye that:

Alvina Conner has filed, in the County Court of Panola County, an application to probate the last will and testament of Estate of Nelson Conner, Dec’d filed with said application on the 1st Monday the 4th day of May A D 1891 at the Court house thereof, in the Town of Carthage at which time all persons interested in said Estate may appear and contest said application, if they see proper.

HEREIN FAIL NOT, under penalty of the law, and of this Writ make due return.

Given under my hand and seal of office, in the Town of Carthage the 10th day of April 1891

No. 1019, Nelson Conner Will, Filed April 15 the 1891, Panola County Probate Court, Carthage, Texas.

The State of Texas () Know all men by these presents that I, Nelson Conner of county of Panola and State of Texas, being of sound mind and memory, and being desirous of settling my worldly affairs while I have strength and mind, do make this my last will and testament hereby revoking all others here to made by me.

Item 1st. I direct and it is my will that all my just debts be paid immediately after my death by my beloved wife, and that my body be buried in a decent and Christian like manner.

Item 2nd. I give and bequeath to each of my children: William B. Conner, Ann Forsyth, and Martha E. Moseley five dollars each, and to my three grandchildren: Gary Conner, Willie Conner, and Julia Conner, I give each one dollar sixty six and two thirds cents. And I direct that my said wife Almira pay said amounts to each of said parties immediately after my death, that is, as soon as she can get up the money without making a sacrifice of any property to raise said amount.

Item 3rd. I give and bequeath to my beloved wife Almira Conner all my other property of whatever description, including real, personal and mixed such as my lands, mules, horses, cows, wagons, and all other property of whatever kind I may own and possess at the time of my death.

Item 4th. It is my will and I hereby constitute and appoint my beloved wife Almira Conner, Executrix of this my last will and Testament, and I further direct that she give no bond and that the Probate Court take and exercise no control in the matter except to probate this will and receive and approve an inventory and appraisement of said estate.

County of Panola () Texas, May Term 1891

To the Hon J.H. Long, County Judge

Your petitioner Almira Conner with respect shows to the court that Nelson Conner departed this life, domiciliated in the county of Panola and State of Texas, about the last day of January 1891. That the deceased resided in said county and state. That the deceased left a written will at the time of his death and was possessed of real and personal property at the time of his death of the estimated value of three hundred dollars, all of which is situated in Panola County Texas. That applicant is the surviving wife of deceased, and was appointed executrix in the will. That her residence is in Panola County, Texas: that she is not disqualified from accepting letters under said will. Wherefore, she prays the court to appoint her executrix and that she be permitted to return an inventory, list of claims as directed in the will.

County of Panola () May Term 1891

In the estate of Nelson Conner, deceased.

On this 4th day of May 1891 personally appeared in open court J.E. Biggs who, being duly sworn, says, that on the 18th day of September 1890, he was present and saw Nelson Conner sign the instrument filed in this court on the 15th day of April 1891, and now shown to him bearing date on the 18th day of Sept. 1890 and purporting to be the last will of him the said Nelson Conner and saw him sign the same as his last will, that at the time of signing the same the said Nelson Conner was over twenty one years of age and of sound mind; that this affiant and W.J. Shivers whose signature appears on said instrument on said 18th day of Sept. 1890 then being credible witnesses above the age of fourteen years subscribed their names as witnesses to the same in the presence and at the request of said testator and in the presence of each other. That afterwards on or about the 20th day of January 1891 said Nelson Conner died, in said county of Panola and State of Texas in which he had his domicile at and before his death and without having revoked said will so far as known to affiant, that citation has been served and returned in the manner and for the length of time required by law.
